Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PublicOptions API, website, and dashboard (collectively, the “Service”), operated by PublicOptions (“we”, “us”). By creating an account or making any request to the Service, you (“you”, “Customer”) agree to be bound by these Terms.
1. Account & eligibility
You must be at least 18 years old and capable of forming a binding contract. You are responsible for safeguarding your credentials and API keys, and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
2. The Service
The Service provides a REST API to historical price data for US equity options sourced from third-party data providers (the “Data Provider”). Data is provided “as is” for informational purposes only and is not investment advice, an offer to buy or sell any security, or a recommendation. You are solely responsible for any trading or investment decisions you make.
3. Subscriptions, fees & billing
Paid plans renew automatically each billing period until cancelled. Fees are non-refundable except as required by law or as described in our refund policy. You authorize us and our payment processor (Stripe) to charge your payment method for all fees due. We may change pricing on at least 30 days’ notice; changes take effect on your next renewal.
4. Acceptable use
Your use of the Service is also subject to our Acceptable Use Policy, which is incorporated by reference. Violations may result in immediate suspension or termination without refund.
5. Rate limits & quotas
Each plan includes a monthly request quota. Requests beyond the quota return 429 Too Many Requests. We may throttle or suspend accounts that generate sustained load incompatible with the purchased plan.
6. Customer data & license
You retain all rights in queries, code, and any data you submit. You grant us a worldwide, non-exclusive license to process this data solely to operate, secure, and improve the Service. Response data is licensed from the Data Provider on your behalf and may be used internally within your organization. You may not resell, redistribute, or expose raw response data to third parties as a substitute for a direct license.
7. Intellectual property
We retain all rights, title, and interest in the Service, including software, documentation, trademarks, and the structure and design of API responses. Nothing in these Terms transfers ownership.
8. Confidentiality
Each party will protect the other’s non-public information using at least the same care it uses for its own, and use it only to perform under these Terms.
9. Warranties & disclaimers
EXCEPT AS EXPRESSLY STATED, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY OF ACCURACY, TIMELINESS, OR COMPLETENESS OF THE DATA.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST-PROFIT DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You will defend and indemnify us against third-party claims arising from your use of the Service in violation of these Terms or applicable law.
12. Suspension & termination
We may suspend or terminate your access for material breach, non-payment, or to comply with law. You may terminate at any time from the dashboard; termination takes effect at the end of the current billing period.
13. Changes to the Terms
We may update these Terms from time to time. Material changes take effect 30 days after we post the updated Terms or email account owners, whichever is later. Continued use after the effective date constitutes acceptance.
14. Governing law & venue
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute.
